Coalition of States Investigates OpenAI Over ChatGPT's User Impact
A coalition of state attorneys general has launched an investigation into OpenAI, focusing on how its products, including ChatGPT, impact users. New York State Attorney General Letitia James issued a subpoena to OpenAI, seeking a wide range of documents related to user engagement, data handling, and the company's interactions with young and older users. OpenAI has stated it is taking the concerns seriously and is committed to learning and engaging constructively with the investigating offices.
A group of state attorneys general has initiated an investigation into OpenAI, the developer of ChatGPT. The probe aims to understand the impact of the company's artificial intelligence products on users, particularly minors and vulnerable adults.
New York State Attorney General Letitia James served OpenAI with a subpoena, requesting various documents. These documents pertain to user engagement and retention, the company's management of health and consumer data, its deep learning models, and activities involving young and older users.
In response, OpenAI stated it is taking the concerns "seriously" and is "committed to learning" and improving its products. A spokesperson for the company said that today's ChatGPT includes a more protective experience for minors and individuals in difficult situations, with safeguards designed to direct them to real-world resources and human contacts.
This investigation follows other legal challenges for OpenAI, including copyright infringement claims, privacy lawsuits, and a dispute involving SpaceX CEO Elon Musk and OpenAI CEO Sam Altman. The company has also faced lawsuits alleging ChatGPT contributed to user decisions to die by suicide. In response to such claims, OpenAI has stated that ChatGPT is not a substitute for medical or mental health care and that it has strengthened its responses in sensitive situations with expert input.
Additionally, a lawsuit has been filed against OpenAI by the family of a victim in a fatal campus shooting at Florida State University, alleging ChatGPT's safeguards failed to recognize threats in the shooter's conversations. Florida Attorney General James Uthmeier filed another complaint, asserting ChatGPT has "aided and abetted deadly rampages" and "encouraged vulnerable people into suicide," also claiming user addiction without parental oversight. OpenAI has responded by introducing further safety measures.
The coordinated investigation by state attorneys mirrors a similar multi-state investigation into TikTok, which resulted in a 14-state lawsuit. This strategy, often led by the attorneys general of California and New York, is a common approach for states when engaging with large corporations. According to Business Insider, lawyers suggest this method makes it more expensive for companies to defend and allows cases to continue in other states even if one falters.
